Terms of Service

1. License Grant

PropanePal is licensed, not sold. Subject to your compliance with these Terms, Timothy J. Casatelli ("Developer," "we," "us," or "our") grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use PropanePal on an Apple-branded device that you own or control, solely for your personal, non-commercial purposes, and solely as permitted by the Apple App Store Terms of Service.

You may not:

• Copy, reproduce, or duplicate the app or any portion of it
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the app
• Modify, adapt, translate, or create derivative works based on the app
• Rent, lease, lend, sell, sublicense, distribute, or transfer the app or your license to any third party
• Remove or alter any proprietary notices, labels, or marks in the app
• Use the app for any commercial purpose or for any public display, whether commercial or non-commercial

This license is automatically revoked if you violate any of these Terms. Upon termination, you must cease all use of the app and delete all copies from your devices.

2. Intellectual Property

All right, title, and interest in and to PropanePal — including but not limited to the app code, user interface design, visual design, calculation engine, prediction algorithms, icons, logos, graphics, text, and all other content — are owned exclusively by Timothy J. Casatelli and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.

These Terms do not grant you any ownership interest in PropanePal. You receive only the limited license described in Section 1. Nothing in these Terms transfers any intellectual property rights to you.

The name "PropanePal" and the PropanePal logo are proprietary marks of Timothy J. Casatelli. You may not use them without prior written permission.

3. User Responsibilities & Safety Disclaimer

PropanePal is a tracking and estimation tool. By using it, you acknowledge and agree to the following:

• You are solely responsible for the accuracy of all readings, fills, and other data you enter into PropanePal.
• You are solely responsible for all decisions related to your propane supply, including when to order, when to stop using appliances, and how to respond to low propane conditions.
• You must always manually verify your propane tank gauge before relying on any prediction or recommendation from PropanePal.
• You must contact your propane supplier immediately if your tank is critically low or if you suspect a leak.
• Propane is a flammable, pressurized gas. All safety decisions related to your propane system must be made by you, in consultation with qualified professionals and your supplier as appropriate.
• You assume all risk arising from your use of PropanePal and from your propane system.
• PropanePal is for personal, informational use only and is not a substitute for professional propane monitoring equipment, safety inspections, or supplier guidance.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TIMOTHY J. CASATELLI, HIS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY
• DAMAGES ARISING FROM APP MALFUNCTION, CRASHES, ERRORS, OR INTERRUPTIONS
• DAMAGES ARISING FROM PREDICTION INACCURACY OR FAILURE
• DAMAGES ARISING FROM AN EMPTY PROPANE TANK OR PROPANE SUPPLY INTERRUPTION
• PROPERTY DAMAGE, PERSONAL INJURY, DEATH, OR FIRE RELATED TO YOUR PROPANE SYSTEM
• DAMAGES ARISING FROM YOUR RELIANCE ON ANY DATA, ESTIMATE, OR RECOMMENDATION IN THE APP
• DAMAGES ARISING FROM LOSS OF OR INABILITY TO ACCESS YOUR DATA

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, AND EVEN IF DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, DEVELOPER'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN SUCH JURISDICTIONS, THE ABOVE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED.

DEVELOPER'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TEN DOLLARS (USD $10.00).

5. No Warranty — App Provided "As-Is"

PROPANEPAL IS PROVIDED "AS-IS," "AS AVAILABLE," AND "WITH ALL FAULTS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE APP WILL BE ERROR-FREE, BUG-FREE, OR UNINTERRUPTED
• WARRANTIES THAT PREDICTIONS, ESTIMATES, OR RECOMMENDATIONS WILL BE ACCURATE OR RELIABLE
• WARRANTIES THAT THE APP WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS
• WARRANTIES RELATED TO DATA INTEGRITY OR PRESERVATION

YOU ACKNOWLEDGE THAT YOU HAVE NOT RELIED UPON ANY WARRANTY OR REPRESENTATION MADE BY DEVELOPER OR ANY THIRD PARTY IN DECIDING TO USE PROPANEPAL. YOU USE THE APP ENTIRELY AT YOUR OWN RISK.

6. User Indemnification

You agree to defend, indemnify, and hold harmless Timothy J. Casatelli and his affiliates, officers, agents, employees, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of PropanePal
• Your propane system, equipment, or facilities
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your reliance on any prediction, estimate, or recommendation provided by the app
• Any claim by a third party arising from any of the foregoing

Developer reserves the right to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Developer in asserting any available defenses.

7. Premium Subscriptions & In-App Purchases

Purchase and billing. Premium features are available through auto-renewing subscriptions (monthly and annual) and a one-time lifetime purchase, processed through Apple's App Store. By purchasing a subscription or lifetime license, you agree to Apple's App Store Terms of Service and payment policies in addition to these Terms.

Auto-renewal. Auto-renewing subscriptions are charged to your Apple ID payment method at the then-current price at the start of each billing period, unless cancelled at least 24 hours before the renewal date. You are responsible for managing your subscriptions through Apple ID account settings.

Price changes. Developer may change subscription prices at any time upon 30 days' notice. Your continued use of the subscription after the price change takes effect constitutes your acceptance of the new price. Price changes will be communicated through the App Store and, where possible, within the app.

Refunds. All refund requests are subject to Apple's App Store refund policy. Developer has no obligation to provide refunds beyond what Apple's policy requires. As a general guideline, refund requests within 7 days of purchase may be granted at Apple's discretion. Lifetime purchases are non-refundable after 7 days from the purchase date. Partial-period refunds for subscriptions are not provided.

Cancellation. You may cancel a subscription at any time through iOS Settings → [Your Name] → Subscriptions. Cancellation takes effect at the end of the current billing period. You will not receive a prorated refund for unused time. Access to Premium features continues until the end of the paid period.

Developer's payment obligations. Developer is not a party to the payment transaction between you and Apple. Developer does not store or process payment information. All billing disputes must be directed to Apple.

8. Premium Feature Availability

Developer reserves the right, at any time and without notice or liability, to:

• Modify, update, or change any Premium feature
• Temporarily or permanently suspend access to any Premium feature
• Discontinue any Premium feature entirely
• Add new features to, or remove features from, any subscription tier

Developer is not liable to you or any third party for any modification, suspension, or discontinuation of Premium features. Features described as "coming soon" are planned but not guaranteed — their availability, timing, and final form are subject to change at Developer's sole discretion.

Your sole remedy if you are dissatisfied with a feature change is to cancel your subscription through Apple.

9. Data, Storage & Deletion

Free users have all data stored locally on their device. Premium subscribers may enable iCloud sync, which stores data in their personal iCloud account. Developer has no access to, and does not operate any server storing, any data you enter into PropanePal.

• Free user data is stored on your device and remains under your exclusive control.
• Premium iCloud sync data is stored in your personal iCloud account, governed by Apple's iCloud terms and privacy policy.
• Developer has no responsibility for the preservation, backup, or recovery of any data you store in PropanePal.
• Deleting PropanePal data through Settings → Delete All Data is permanent and irreversible. Developer cannot restore deleted data.
• Uninstalling PropanePal from your device permanently deletes all locally stored data. iCloud sync data (Premium) can be managed separately via iOS Settings.
• No Developer recovery service exists. You are solely responsible for maintaining backups via iOS backup or iCloud sync features.

10. App Updates & Discontinuation

Developer may, at any time and without prior notice or liability, update, modify, or discontinue PropanePal or any portion of it. Developer is under no obligation to maintain, update, or continue supporting PropanePal.

Developer is not liable for any loss, damage, or inconvenience arising from:

• App updates that change or remove functionality
• The discontinuation or end-of-life of PropanePal
• PropanePal becoming unavailable on the App Store
• Loss of access to the app or your data due to app discontinuation
• Incompatibility with future iOS versions

11. Dispute Resolution & Governing Law

Governing law. These Terms and any dispute arising out of or related to them or your use of PropanePal shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.

Mandatory arbitration. EXCEPT FOR SMALL CLAIMS COURT ACTIONS, ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF PROPANEPAL — INCLUDING WITHOUT LIMITATION ANY QUESTION REGARDING THEIR EXISTENCE, VALIDITY, OR TERMINATION — SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") UNDER ITS CONSUMER ARBITRATION RULES, RATHER THAN IN COURT. The arbitration shall be conducted in Arizona, United States. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. YOU AND DEVELOPER EACH WAIVE ANY RIGHT TO PURSUE DISPUTES ON A CLASS, CONSOLIDATED, OR REPRESENTATIVE BASIS. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. This class action waiver is an essential element of the arbitration agreement between you and Developer. If this waiver is found unenforceable, the entire arbitration agreement shall be void and unenforceable, and any disputes shall be resolved in court.

Jury trial waiver. TO THE EXTENT ANY DISPUTE IS RESOLVED IN COURT (AND NOT IN ARBITRATION), YOU AND DEVELOPER EACH WAIVE ANY RIGHT TO A JURY TRIAL.

Time limitation. Any claim you bring against Developer must be initiated within one (1) year after the claim arises, or it is permanently barred. This limitation applies regardless of any statute of limitations to the contrary.

Venue. For any matters not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Arizona, United States.

12. General Provisions

Entire agreement. These Terms, together with the Privacy Policy and any additional terms specific to features you use, constitute the entire agreement between you and Developer regarding PropanePal. They supersede all prior agreements, representations, warranties, and understandings between the parties relating to PropanePal.

Modifications. Developer may modify these Terms at any time. Developer will provide at least 30 days' advance notice of material changes by updating the "Last updated" date on this page and, where feasible, providing notice within the app. Your continued use of PropanePal after changes take effect constitutes your binding acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using PropanePal.

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

No waiver. Developer's failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or of the right to enforce it in the future. No waiver by Developer of any breach shall constitute a waiver of any subsequent breach.

Assignment. You may not assign or transfer these Terms, or any rights or obligations under them, without Developer's prior written consent. Developer may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

Relationship of the parties. These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship between you and Developer.

Force majeure. Developer is not liable for any delay or failure to perform resulting from causes beyond Developer's reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, power outages, or failures of third-party services.

Apple terms. PropanePal is distributed through the Apple App Store. These Terms are between you and Developer only, not Apple. Apple is not a party to these Terms and has no obligation to provide any maintenance or support for PropanePal. If there is any conflict between these Terms and the Apple App Store Terms of Service, the Apple terms shall govern solely with respect to your relationship with Apple.
